1. Introduction

(a) Who We Are: Property Maintenance SA is a South Australian company providing residential and commercial property maintenance and Handyman services. We comply with all relevant South Australian laws and regulations.

Agreement: By booking our services (through phone, email, our website, or in person), you agree to be bound by these Terms and Conditions (“Terms”).
2. Quotes, Pricing and Changes

Estimates: Our quotes are based on the information you provide and are valid for 30 days. Final costs may vary due to unforeseen circumstances, changes in the scope of work, or inaccurate information provided by you. Any price changes will be discussed and require your written approval.

Hourly Rates: Some jobs may be charged on an hourly basis with a minimum fee. Changes to the agreed-upon work may affect the price.

Materials Availability: We generally source and include materials in your quote, but some items may be unavailable due to circumstances beyond our control. We are not liable for issues with the materials you provide.

Changing Circumstances: We reserve the right to adjust pricing or pause work if circumstances beyond our control significantly impact the project.
3. Booking, Scheduling, and Cancellations

Acceptance of Terms: By booking our services, you confirm that you have read, understood, and agree to these Terms.

Scheduling: We will provide an estimated arrival timeframe. We strive to be punctual, but unforeseen events (e.g., traffic, weather) may cause delays. Start and completion dates are estimates, not guarantees.

Changes/Cancellations: Please provide at least 72 hours notice (during office hours) for any changes or cancellations. Cancelling an accepted quote may result in fees to cover our incurred expenses.
4. Safety and Your Responsibilities

Safe Work Environment: Please provide a safe work area with access to electricity, hot water, toilet facilities, and secure storage for our team. Remove valuables and secure pets.

Ownership & Permits: You must have full rights to authorise work on your property. It's your responsibility to ensure the property is suitable and all necessary permits are in place.

Hazards: Inform us of any hazards (e.g., asbestos) before we start work.

Subcontractors: We are not liable for issues caused by subcontractors or faulty products they supply.

Work Hours: Quotes generally assume work during regular business hours. Work requested outside these hours may incur additional charges.
5. Materials

Our Responsibility: We generally source and include the cost of materials in your quote. Parts provided by us that become faulty during the installation period will be replaced. Later faults may incur charges.

Your Choice: You may opt to provide your own materials. We are not liable for issues arising from client-supplied materials and reserve the right to refuse to use unsuitable items.
6. Payment

Methods: We accept cash, bank transfers, debit/credit cards, Apple Pay, Google Pay, Zip, Afterpay, and PayPal. Transaction fees may apply.

Deposits: A 50% deposit is generally required to book your job, covering material and equipment costs. The balance is due immediately upon job completion.

Payment Plans: Flexible payment plans may be available for larger projects; please contact us for details.

Late Payments: Overdue accounts may incur fees and interest.

Security: We may place a charge over your property to help secure unpaid invoices.

GST: Our prices are inclusive of GST (Goods and Services Tax). Your invoice will show the tax amount.
7. Workmanship Guarantee, Feedback, and Liability

Quality Guarantee: We guarantee our workmanship. Materials are covered by manufacturer warranties.

Issues: Please notify us within 7 days (72 hours for End of Tenancy cleans) of any issues for prompt resolution.

Feedback: We value your input. Please let us know about any questions, concerns, or positive experiences you had.

Limits of Liability: We're not liable for circumstances beyond our reasonable control. You agree to protect us against claims (except those caused directly by us) arising from your actions or omissions.
8. Additional Legal Provisions

Intellectual Property: We retain ownership of intellectual property created during the project unless otherwise agreed in writing.

Termination: Either party may terminate this agreement with cause (e.g., breach of contract) upon written notice.

Dispute Resolution: In the unlikely event of any dispute arising between the parties, they shall first endeavour to resolve the matter through mediation conducted in good faith. If mediation is unsuccessful, either party may pursue legal action.

Governing Law: These terms are governed by South Australian law, and any legal proceedings will be held in an appropriate South Australian court.

Entire Agreement: These Terms constitute the entire agreement between us and supersede any previous communications.

Severability: If any provision is unenforceable, the remaining provisions remain valid.

Assignment: Rights and obligations under this agreement may not be assigned without prior written consent.

Waiver: Waiver of any breach does not constitute a waiver of subsequent breaches.

Notices: Notices will be delivered according to methods outlined in the agreement.

Headings: Headings are for reference only and do not affect interpretation.
